Can I withhold my service charge? Risks and safe options

England and Wales · Law checked 24 October 2026 · Not legal advice

Withholding is risky unless the law clearly allows it. Situations where payment is not yet due or can be withheld include:

Forfeiture protection

For a residential long lease, a landlord generally cannot forfeit for unpaid service charges unless the amount has been agreed or admitted, or determined by a court or tribunal (s.81 Housing Act 1996), and there are small-debt limits. Forfeiture threats are serious, so get advice from LEASE or a solicitor at once. See arrears and forfeiture for the £350 and three-year rules.

Safest route: pay the undisputed part, dispute the rest in writing, and apply to the tribunal if needed.
